JUSTICE PURNENDU SINGH ORAL ORDER 27-07-2026 Heard Mr. Onkar Nath, learned counsel appearing on behalf of the petitioner; Mr. Gyan Prakash Ojha, learned GA-7 for the State and Mr. Dr. Anand Kumar, learned counsel for the Accountant General, Bihar.

2. The petitioner in paragraph no. 1 of the present writ petition has sought, inter alia, the following relief(s), which is reproduced hereinafter:- "1) That this is an application for issuance of an appropriate writ/writs, order/orders or direction for:-

Patna High Court CWJC No.8529 of 2026(2) dt.27-07-2026 2/3 (i) Commanding the respondent authorities particularly the Resp. No.-3 & 6 to do the payment of the amount of G.P.F. under the heading of pensionary benefit/s alongwith statutory interest henceforth accordingly.

(ii) Further commanding the respondent authorities to revise & fix the pension after consideration and grant of the benefits of third ACP. (iii) Grant of any other consequential or incidental relief/reliefs, for which the petitioner can be found entitled for."

3. Learned counsel appearing on behalf of the petitioner seeks to file a detailed representation before the Chief Medical Officer-cum-Civil Surgeon, Patna (respondent no. 3) for the relief(s) as prayed for in the present writ petition.

4. In view of the aforesaid submission, the petitioner, if so advised, may file a detailed representation before the Chief Medical Officer-cum-Civil Surgeon, Patna (respondent no. 3), who is directed to call for the service particulars relating to the petitioner, who had retired on 31.01.2025 from the post of Auxiliary Nurse Midwife (A.N.M.), from the Additional Primary Health Centre, Jalalpur, which falls under the Primary Health Centre, Mokama and see that admitted dues is paid to the petitioner by disposing of the representation filed on behalf of the petitioner, well within a period of six weeks from the date of communication of this order, in accordance with law.

5. In case of failure of payment of admitted due, the petitioner is at liberty to take action against the respondent
