JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 29.10.2015 Heard learned counsel for the petitioner, learned Addl. Public Prosecutor for the State as well as learned counsel for the informant.

Informant claims that the deceased was taken from his house by the petitioner and one Rajesh Mandal who later on, informed the informant's son that the deceased was being assaulted by the petitioner and after that dead body of the deceased was recovered beneath a bridge.

Police has already completed investigation but it is surprising enough that statement of Rajesh Mandal was not recorded by the Investigating officer. Moreover, except the aforesaid material, there appears to be nothing against the petitioner who does not have any criminal antecedent.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
