JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-03-2018 The prayer of the petitioner before the trial court for summoning of the records of another case as well as the injury report of the accused persons, of that case has been refused.

The records reveal that in the present case, the prosecution evidence was closed on 26.08.2013. Thereafter, the matter was kept pending for defence evidence till 13.04.2015. The defence evidence was closed at their request. After the arguments were over, the aforesaid petition seeking summoning of

Patna High Court CR. REV. No.381 of 2016(3) dt.27-03-2018 2/2 records of another case was filed, thereby making a request for re-opening the defence case.

The trial court refused to accede to the prayer of the petitioner for the reason that ample opportunities were available to the petitioner for bringing such documents which they did not avail of.

There is no reason to interfere with the order. The present petition is misconceived and is dismissed.
