ANJANA MISHRA ORAL ORDER 11-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are apprehending their arrest in connection with Morhowrah P.S. Case No.99 of 2015 for allegedly having committed the offences under Sections 147, 148, 149 and 302 of the Indian Penal Code.

Learned counsel for the petitioners submits that on account of the altercation, both parties sustained injuries. It is submitted that for the same occurrence, petitioner No.4 has also lodged an F.I.R. on 10.4.2015. Admittedly, there has been an altercation between both the parties as is evident from perusal of

Patna High Court Cr.Misc. No.30463 of 2015 (2) dt.11-08-2015 2/2 the two F.I.Rs. It is further submitted by the learned counsel for the petitioners that the allegations against the petitioners is general and omnibus in nature and no particular person can be saddled with the liability of having given the blow which resulted in the death of the deceased Suryadeo Puri.

Considering the aforementioned facts and circumstances and also the fact that the petitioners have no criminal antecedents, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra, in connection with Morhowrah P.S. Case No.99 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
