2. The petitioner is in custody in a case registered for the offences punishable under Sections 395, 397, 412, 414, 467, 468, 471, 420 and 120(b) later on 420 of the IPC and Sections 25(1-B)A, 26, 27 and 35 of the Arms Act.
3. This is the second attempt for regular bail of this petitioner, earlier the bail of the petitioner was rejected by this Court vide order dated 19.04.2024 passed in Cr. Misc. No. 12379 of 2024 with a 'direction to the learned Trial Court to conclude the trial within a period of one year from the date of receipt of a copy of this order.'
4. As per the prosecution case, some miscreants have looted the Canara Bank by making firearm injury.
5. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that charges has been framed and no independent prosecution witness has been examined as yet. He next submits that one similarly situated co-accused person, namely, Md Aftab
Patna High Court CR. MISC. No.33844 of 2025(2) dt.20-06-2025 2/2 @ Aftab Ali @ Aftab Alam has already granted bail by this Court vide order dated 13.03.2024 passed in Cr. Misc. No.18602 of 2024. He further submits that petitioner has got one criminal antecedent but fairly submits that he is on bail as stated in a para-3 of his bail petition. He next submits that petitioner is under custody since 11.10.2023.
6. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
7. Considering the aforesaid facts and circumstances of the case, submissions made on behalf of the petitioner and the fact that progress of the trial is not likely to be concluded in near future as well as the fact that petitioner is under custody since more than one year, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-V, Madhubani in connection with S.T. No.130 of 2024 arising out of Rahika P.S Case No. 225 of 2023 with a condition that petitioner will remain physically present before the learned Trial Court in each and every date fixed by the learned Trial Court.
