IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Writ Jurisdiction Case No.1148 of 2016 ====================================================== Manik Chand Mahto @ Khemka Mahto Son of Late Sheo Nandan Mahto, resident of Village: Manikpur, P.S: Suryagarha, District: Lakhisarai. .... .... Petitioner

Versus

The State of Bihar through the Principal Secretary, Home Department, Govt. of Bihar, Patna.

.... .... Respondents ====================================================== Appearance :

For the Petitioner/s : Mr. Pawan Kumar Singh For the Respondent/s : Mr. Partha Sarthy (Ga 4) ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 2.

23-08-2018 A totally misconceived application has been filed but the fault of filing such petition cannot be fastened upon the petitioner. It appears that against the order of conviction of the petitioner a criminal appeal has been preferred in which he is on bail, as it appears from the order dated 13.09.1990, passed in Criminal Appeal No. 382/1990 (Annexure-1 to the writ application).

In these circumstances, if the petitioner has been advised to file the present writ application, this court would not appreciate the same. The application being totally misconceived and is hereby dismissed.
