The notice inviting tender dated 17.07.2018 would proceed but two vacancies would be kept reserved for the petitioners until final decision is taken by the District Transport Samiti of Bihar State Food & Civil Supplies Corporation, Motihari. It is expected that the District Transport Committee will take a decision within a period of four weeks from the date of receipt/production of the copy of the order..."

2. Opposite party No. 7 has filed a show-cause wherein, in paragraph-5 it has been stated as under: "...5. That in the light of the order passed by Hon'ble High Court the Chairman cum District Magistrate has taken a decision on 21/2/19 by which the claim of the petitioner has been rejected as per clause 9(ix) of Tender. It is also relevant to state here that on 17/7/18 Four (4) post of Transport Handling cum Supply Agent Door Step Delivery (DSD) was advertised and till today no one DSD Transporter against above advertisement has been appointed by the opposite party..."

3. A copy of the decision taken by the Chairman cum District Magistrate dated 21.02.2019 of the tender, by which claim of the petitioner has been rejected as per clause 9(ix) has

4. On perusal of the show-cause filed by the opposite party No. 7 and the Annexure-A of the show-cause, I find that the order dated 27.08.2018 passed in CWJC No. 13230 of 2018 and CWJC No. 13237 of 2018 has been complied with by the respondents.

5. Accordingly, this contempt application stands closed and disposed off.
