Petitioner is named in first information report but no specific overt act has been attributed against him. No doubt, the occurrence took place in the year, 2004 and the charge sheet was submitted on 28-08-2006 showing the petitioner as absconder but submission on behalf of the petitioner is that neither any notice nor any process was ever served upon the petitioner and all of a sudden, petitioner was arrested by the police on 20-01-2015 and since then, he is languishing in jail custody.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named

Patna High Court Cr.Misc. No.33543 of 2015 (2) dt.18-08-2015 2/2 above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bhawanipur P.S.
