JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 Petitioner seeks regular bail in connection with Naubatpur P.S. Case No.25 of 2019 registered for the offences punishable under Sections 147, 448, 435, 436, 326 & 429 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner and several other accused persons of setting on fire the husband of the informant and also some cattles, casing death. Submission of the learned counsel for the petitioner is that F.I.R. itself shows that allegation of setting fire, he is an accused in some other cases and the petitioner is in custody for more than four months and charge sheet has already been submitted.
Heard learned A.P.P. and learned counsel for informant who has opposed the prayer for bail on the ground
Patna High Court CR. MISC. No.33778 of 2019(2) dt.22-05-2019 2/2 that the husband of the informant has received serious burn injuries.
Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Danapur, in connection with Naubatpur P.S. Case No. 25 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
