2. The petitioner seeks regular bail in connection with Tatarpur P.S. Case No. 48 of 2024 dated 12.02.2024, lodged under Sections 420, 467, 468, 471, 34 of the Indian Penal Code read with sections 25(1)(a), 25(1-b)(a), 26, 35 of the Arms Act pending before the Court of learned Chief Judicial Magistrate, Bhagalpur.
3. As per the prosecution case, FIR has been lodged against 4 named accused persons including the present petitioner against whom there is an allegation that articles appertaining to construction of arms have been recovered.
4. Learned senior counsel for the petitioner submits
Patna High Court CR. MISC. No.40995 of 2024(4) dt.06-09-2024 2/3 that the petitioner is innocent and has committed no offence. Counsel further submits that the petitioner apprehended from the house which belongs to his father and the petitioner has visited his father's house to see what happened and in the meantime, police has arrested him and made accused on the basis of suspicion only. Counsel submits that the criminal antecedent of the petitioner is clean and he is in custody since 13.02.2024. Counsel further submits that the petitioner is nowhere involved in the commission of the crime and he is ready to fulfill all the conditions whatsoever shall be imposed upon him.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that from the seizure list, it transpires that articles for the purpose of manufacturing the gun were found in the house from where, the petitioner has been arrested. Counsel further submits that from the FIR, it transpires that the entire family members were involved in the business of construction of arms.
6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.
7. Accordingly, the prayer for regular bail of the petitioner is hereby rejected.

8. Liberty is hereby granted to the petitioner that he may renew his prayer for bail after framing of charge. (Dr. Anshuman, J) Divyansh/- U T
