Mr. Madan Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 13-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Excise P.S. Case No. 337 of 2025, instituted for the offence under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.

3. There is recovery of 57.240 litres of foreign liquor from the back side of the house of petitioner kept beneath the straw. Petitioner managed to flee away.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner. Recovery of illicit liquor has been made from an

Patna High Court CR. MISC. No.42348 of 2025(3) dt.13-10-2025 2/2 open place which is accessible to anyone. Petitioner has no concern with the seized liquor. Petitioner has one criminal antecedent which is of similar nature. He undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the Petitioner, above-named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Second, Aurangabad in connection with Excise P.S. Case No. 337 of 2025, subject to the conditions laid down in Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
