The grievance of the petitioner in the present writ application is indecisiveness on the part of the licensing authority in the matter of grant of arms license. The grand-father of the petitioner was granted arms license, who died on 11.07.2015. Thereafter, the petitioner filed application for issuance of arms license and also for transfer of SBBL Gun of his late grand-father before the District Magistrate, Rohtas.
Learned counsel for the petitioner submits that on
Patna High Court CWJC No.11316 of 2019(2) dt.17-06-2019 2/2 30.08.2015, the petitioner filed application for grant of arms license, but approximately for the last four years the respondents are sitting tight over the matter.
Under the aforesaid circumstance, instead of keeping the matter pending, the writ application is disposed of with a direction to the District Magistrate, Rohtas to take appropriate decision in the matter of grant of Arms license of the petitioner in accordance with 2016 Rules and the law laid down by the Division Bench of this Court in the case of State of Bihar & Ors. Vs. Deepak Kumar, reported in 2019 (1) PLJR 664. Necessary decision in this regard must be taken by the respondents within a period of four months from the date of receipt/production of a copy of this order.
With the aforesaid, this application stands disposed of. (Anil Kumar Upadhyay, J) uday/- U
