JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 13-10-2015 After some argument, learned counsel for the petitioner seeks withdrawal of instant petition in the background of further development ensuing in between whereunder case has been compromised amongst the parties.
Accordingly, instant petition is dismissed as withdrawn with a direction to the learned lower court to expedite the trial and will conclude the same by the end of December, 2015, in case there happens to be active cooperation at the end of accused persons by having presence of witnesses in the background of compromise. Learned lower court is strictly directed to conclude the trial by the end of December, 2015. If the trial is not concluded within the stipulated period and for that, petitioner is not held responsible then, in that event, the learned lower court will release the petitioner on bail but before that an
Patna High Court Cr.Misc. No.31769 of 2015 (3) dt.13-10-2015 explanation be furnished before this Court regarding nonconclusion of the trial within the stipulated period and further the office is directed to place the report immediately after receipt thereof. In case of non-cooperation at the end of petitioner, the learned lower court will seek help from the Superintendent of Police, Purnea and further, Superintendent of Police, Purnea is directed to produce all the witnesses so that the trial be concluded within the stipulated period. Office to communicate the order impugned upon Superintendent of Police, Purnea as well as learned lower court respectively.
