Patna High Court CWJC No.8857 of 2024(2) dt.22-07-2024 2/3 direction or writ in the nature of Certiorari for quashing order dated 08.11.2023 (AnnexureP/3) which has been passed by SubDivisional Public Grievance Redressal Officer, Phulparas, District- Madhubani whereby it has been held that the land of Vishwanath Mandal is Raiyati Land, basis New Survey Khatiyan and further for quashing order dated 16.02.2024 (Annexure-P/5) passed by Additional Collector (Public Complaint Grievance Redressal) Madhubani, whereby and whereunder the appeal preferred by petitioner has been dismissed and the SubDivisional Officers order has been affirmed that the nature of land is Raiyati Land and settlement of dispute is possible by competent court.

(II) For issuance of an appropriate order, direction or writ in the nature of MANDAMUS commanding the respondents to vacate the public land Gair Majarua Aam, Mauza Chhota Udhwa, Khata No.36, Khesra No.36, Area-26-6 (Two Bigha, 6 katha 6 Dhur) categoryRasta Block/Circle- Khutauna, Sub-DivisionPhulparas, District- Madhubani." 2.

At the outset, the learned counsel for the petitioner seeks not to press the present writ

Patna High Court CWJC No.8857 of 2024(2) dt.22-07-2024 3/3 petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
