The petitioners seek bail in Dumariyaghat P.S. Case No. 54 of 2019, instituted for the offence under Section(s) 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act.

It is alleged in the written report that 215.250 litres of foreign liquor has been recovered from dickey of Maruti Suzuki Car as mentioned in the written report. The petitioners were found sitting in the aforesaid car.

Counsel for the petitioners submits that petitioners have no criminal antecedent. They were sitting as passengers

Patna High Court CR. MISC. No.32874 of 2019(3) dt.28-06-2019 2/2 in the car. They are in custody since 28.3.2019. Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 9th Additional Sessions Judge cum Special Judge, Excise, East Champaran, Motihari, in connection with Dumariyaghat P.S. Case No. 54 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners.
