JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-08-2015 Heard learned counsel for the petitioner, learned counsel for the complainant as well as learned Additional Public Prosecutor for the State.

Petitioner being husband of the victim is languishing in jail custody since 27.03.2015 in a complaint case in which cognizance has been taken for the offences punishable under Sections 498A and 494 of the Indian Penal Code. Learned counsel for the petitioner drew my attention towards Annexure-3 to this petition and submits that the victim fled away from her parental home for which father of the victim gave information to Officer in Charge of Raxaul Police Station

Patna High Court Cr.Misc. No.31785 of 2015 (2) dt.14-08-2015 2/2 and on the basis of aforesaid information a Sanha entry was made in respect of missing of the victim.

Learned counsel appearing for father of the complainant/victim submits that father of the complainant had not filed any Sanha and as a matter of fact during pendency of Complaint Case No. 152 of 2013, the victim went to her in laws house from where she was found missing and she is still traceless. Considering the aforesaid facts and circumstances as well as submissions of the parties, particularly, taking note of this fact that even after missing of victim her father did not lodge any case against the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Srivastava, Judicial Magistrate 1st Class, Motihari in connection with Complaint Case No. 152 of 2013.
