The petitioners seek bail in a case registered for the offences punishable under sections 307, 379 and other allied sections of the Indian Penal Code and section 25(1-b)a, 26, 27 and 35 of the Arms Act.
The informant police officer of Gopalpur police station made an allegation that the petitioners tried to kill the informant after snatching his service revolver. Both the petitioners were apprehended with rife and service revolver of the informant. It is submitted that the rifle is a licensee one which is in the name of father of the petitioner no. 1. Patna High Court Cr.Misc. No.32100 of 2015 (2) dt.18-08-2015 petitioner no. 1 filed a Title Eviction Suit No. 40 of 2015 for eviction of Gopalpur police station on 13.04.2015 and being annoyed with the aforesaid case, the S.H.O. of Gopalpur police station lodged this false case.
Considering the facts aforesaid, let the petitioners above named, be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Gayatri Kumari, Judicial Magistrate, Patna in connection with Gopalpur P.S. Case no. 56 of 2015.
