2. The petitioner seeks pre-arrest bail in connection with Dariyapur P.S. Case No. 268 of 2017, registered for the offence(s) punishable under Sections 30, 30(a), 37 and 38 of Bihar Prohibition and Excise Act 2016.

3. The allegation is of recovery of 10 litres of countrymade liquor from the house of the petitioner.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in the case. He has no concern either with the seized liquor or trade of liquor in any manner.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Having considered the rival submissions made on behalf of the parties and nature of allegation against the petitioner, the petitioner, above named is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail-bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, Saran at Chapra, in connection with Dariyapur P.S. Case No. 268 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. and subject to the further condition that one of the bailor will be responsible person of the village.

7. The bail application stands disposed of.
