Learned counsel for the petitioner is directed to submit the original petition along with attested affidavits and also remove the defects pointed out by the Registry within two weeks from today.

The petitioner by way of this writ petition assailed the decision of the Project Director, whereby he has refused to upgrade the Middle School, Kharka while another school namely Banchauri School is being considered for up-gradation. Learned counsel submits that Middle School, Kharka

Patna High Court CWJC No.10715 of 2020(2) dt.20-04-2022 2/2 has all the requisite facilities and deserves to be recommended for up-gradation to Class-X.

I have considered the submission.

Question regarding up-gradation of schools is a purely administrative issue which requires to be examined at the level of the educational authorities. The Director, who is the authority will examine finally whether a particular school is required to be upgraded or not as per the facility available there. If sufficient infrastructure is available with the Middle School, Kharka, the petitioner may make an appropriate representation to the Director, who shall examine the issue independently and take a decision by speaking order at its own level preferably within a period of three months from the date of filing of the representation.

The writ petition is disposed of with the aforesaid terms.
