The petitioners have prayed for grant of bail in connection with Amour P.S. Case No. 109 of 2023 registered under sections 302 and 34 of the Indian Penal Code. The allegation against the petitioners along with other is of killing the husband of the informant by tying a rope around his neck.

Learned counsel for the petitioners submits that the petitioner are innocent and have committed no offence. They

No any specific overt act has been levelled against the petitioners in respect of commission of murder of the informant's husband. It is further submitted from para-10 of this petition that both the petitioners are Mama(maternal uncle) of co-accused namely, Farzana and Ashna and only due to this reason, merely on suspicion, petitioners have falsely been dragged in this case. Nothing consistent material has come against the petitioners. Other co-accused persons, namely, Farzana and Ashna have already been granted bail by this Court vide Annexure-2 of this petition. Moreover, the petitioners are languishing in judicial custody since 14.03.2024.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of this case as well as the custody of the petitioners, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Amour P.S. Case No. 109 of 2023 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st
