Petitioner seeks regular bail in a case registered for the offence punishable under Section 386, 504, 506, 307, 34 of the Indian Penal Code and u/s 27 of Arms Act. As per the prosecution case, this petitioner is alleged to have demanded extortion from the informant, took Rs. 20,000/- and also made firing.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case in the background of land dispute prevailing between the parties. No one has sustained any fire arm injury .Petitioner is in

Patna High Court CR. MISC. No.44958 of 2021(3) dt.04-01-2022 2/2 custody since 12.03.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that there is direct and specific allegation against this petitioner of demanding extortion and taking Rs. 20,000/-, pointing pistol at the chest of informant. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the same is rejected.
