2. The petitioner has prayed for bail in connection with Charpokhri P.S. Case No. 15 of 2025 registered for the offence punishable under Sections 109, 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

The case of the prosecution is that on 09.01.2025, the informant gave his fardbeyan in the emergency ward of Jay Prabha Medanta Hospital Kankarbagh, Patna that on 08.01.2025 at about 4-5 pm when he was sitting at his door, four persons came at his door, including the petitioner. It is further alleged that the petitioner has fired shot from his weapon which hit him in the left arm.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has also been submitted that the occurrence is of 08.01.2025. An FIR was lodged on 09.01.2025 and it was brought before the Jurisdictional Magistrate on 15.01.2025 The only allegation against the petitioner is that he has fired at left arm. From the perusal of the injury report which is annexed by the learned counsel for the petitioner as Annexure-2, it goes to show that bandaged wound over left forearm was found. Of course, there is another wound i.e., left side of thorax, but the allegation against the petitioner is only that of firing at left arm. It has further been submitted that in the FIR itself, it is clear that the cause of the occurrence is the land dispute between the parties. Petitioner is languishing in judicial custody since 29.01.2025.
5. The application for bail is opposed by learned APP for the State and he submits that the petitioner has got one criminal antecedent.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named

No.33167 of 2025(2) dt.22-05-2025 3/3 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bhojpur at Ara in connection with Charpokhri P.S. Case No. 15 of 2025.
