The present writ petition has been filed for setting aside the order dated 03.09.2016 vide Gyapank 2937 (annexed as Annexure-1) issued by The Superintendent of Police, Aurangabad (respondent no.5) by which the petitioners were disengaged who were working as S.P.O. (Special Police Officer) in the Rafiganj Police Station under Aurangabad district.

3. Learned counsel for the petitioners submit that their appointment has been made on the post of S.P.O. (Special Police

Patna High Court CWJC No.6744 of 2018(3) dt.13-03-2024 3/3 Officer) and monthly salary was also granted, but by Annexure1, their services were stopped.

4. Learned counsel for the State on the other hand submits that counter affidavit has been filed in which the reply of D.S.P. has come vide Annexure-C that Sanjay Sharma & Ors. were never appointed as S.P.O. (Special Police Officer) in Rafiganj police station under Aurangabad district, and therefore, their claim is absolutely false.

5. In the light of the pleadings made by the parties, both the parties admits that Annexure-1 is relating to a contractual appointment between 10.04.2010 to 31.03.2011 which has never been extended.

6. As such, this Court restrain itself from passing any order in favour of the petitioners. Accordingly, this writ petition is hereby dismissed.
