JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 12-09-2025 Heard learned senior counsel for the petitioner, learned APP for the State, learned counsel for the informant and perused the case diary.

2. The petitioner seeks bail in connection with Danapur P.S. Case No. 982 of 2024, instituted for the offences punishable under Sections 103, 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

3. The prosecution case, in short, is that son of the informant was murdered by two unknown miscreants while he was returning home after closing his mobile shop. It is further alleged that the occurrence took place as Rs. 6,00,000/- was due from the informant for which he always took time and hurled

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the petitioner is in no way connected with the alleged occurrence and sole eye witness of the case has not disclosed the name of the petitioner and on perusal of FIR it transpires that two unknown persons have killed the deceased. Learned counsel further submitted that as a matter of fact, the petitioner's name has transpired in this case during supplementary investigation and on the basis of threat letter given by the petitioner. The petitioner is in custody since 10.02.2025 and has got no criminal antecedent.

Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner and jointly submitted that the petitioner's name has transpired in this case during supplementary investigation on the basis of a threat letter given by the petitioner. Learned counsel for the informant further submitted that, as a matter of fact, the petitioner had love affair with Supriya Kumari @ Simpi, who is the daughter of Vijay Singh

Patna High Court CR. MISC. No.33909 of 2025(5) dt.12-09-2025 3/3 but due to the intervention of Kamal Kishore, the marriage of Simpi was solemnized with Utkarsh and due to the said reason, the petitioner along with co-accused hatched a conspiracy and committed the murder of the deceased.

6. Considering the aforesaid facts and circumstances of the case as also nature and gravity of the offence, this Court is not inclined to grant bail to the petitioner at this stage.

7. The prayer is rejected. The Trial Court is directed to expedite the Trial.

8. However, if the trial is not concluded within a period of six months from today, the petitioner will have liberty to renew his prayer for bail in the Court below. (Rudra Prakash Mishra, J) Alok Verma/- U T
