Mr.Pradeep Narain Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-05-2019 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, being the mother of the husband of the victim, is languishing in custody since 28.09.2018 in a case registered for the offence punishable under Sections 304B, 201 and 120B/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant within six months of the marriage for nonfulfillment of dowry demand of Rupees Fifty Thousand. It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against all the inlaws family members, including the petitioner and the petitioner claims to reside separate from the husband of the victim. It is further submitted that the thrust of accusation is

Learned APP for the State submits that the petitioner is named in the FIR.

Considering the fact that the petitioner is a lady and the thrust of accusation is against the husband of the victim coupled with submission on behalf of the petitioner to the effect that she will regularly appear before the learned Court below on each and every date, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Muzaffarpur, in connection with S. Tr. No.52 of 2019, arising out of Baruraj P.S. Case No. 233 of 2018.

However, learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for three consecutive occasions.
