Mr. Pradeep Narain Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RITESH KUMAR ORAL ORDER 18-05-2026 Heard the learned counsel for the petitioner and the learned A.P.P. appearing for the State.

2. The petitioner apprehends her arrest in connection with Nawada Town P.S. Case No.913 of 2025, for allegedly having committed offences under Sections 126(2), 115(2), 303(2), 109(1), 74, 76, 329(3), 352, 351(2) and 3(5) of the B.N.S., 2023.

As per the prosecution story, which has been lodged on the basis of the written information submitted by the informant, to the effect that on 26.08.2025, at about 10:00 a.m. she along with her family members was present at her shop near Baba Ka Dhaba. All the accused persons, including the petitioner came armed with Lathi, Danda and iron rod and

2/4 started abusing her. Out of fear, the informant went back to her house. The accused persons followed her and again started abusing her and her family members and on objection made by the family members, all the accused persons started assaulting her husband, son and daughter-in-law. Specific allegation of assault is against Deepak Kumar, who was armed with iron rod and inflicted a blow on the head of the informant with intention to kill her. Further, co-accused, Vikash Kumar and Kamlesh Kumar assaulted Dheeraj Kumar on his head, who is son of the informant and when Amit Kumar, Ajit Kumar, Surendra Sao and Beauty Kumari came to rescue them, both Vikash Kumar and Kamlesh Kumar brutally assaulted them by means of Lathi, Danda and iron rod. The allegation against the petitioner is of taking away the gold chain from the neck of the informant.

4. The learned counsel for the petitioner submits that the allegations levelled against the petitioner are false. There is a land dispute in between the parties and a Title Suit is pending in the court of learned Sub-Judge, 1st, Nawada, bearing Title Suit No.270/2025. It is further submitted that a counter case was also lodged by the petitioner herein, bearing Complaint Case No.957/2025. The learned Trial Court has taken cognizance against the informant and others under different sections of the

3/4 B.N.S. and the case is pending before the learned Judicial Magistrate, 1st Class, Nawada. It is further submitted that coaccused, Vikash Kumar has been granted the privilege of anticipatory bail by a learned Co-ordinate Bench of this Court vide order dated 03.12.2025, passed in Criminal Miscellaneous No.77053 of 2025. By the same impugned order, the anticipatory bail petition of co-accused, Deepak Kumar, against whom the allegation of assault is there, has been rejected.

5. The learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that in the impugned order itself, it has come that the petitioner was found to be indulged in assault and this fact has come in the CCTV footage.

Having heard the learned counsel for the parties and after going through the records, it appears that the only allegation against the petitioner is of snatching gold chain from the neck of the informant. Undisputedly, a Title Suit, bearing Title Suit No.270/2025, is pending in between the parties and the petitioner has also filed a complaint case against the informant and others, wherein cognizance has been taken against them. Further, a learned Co-ordinate Bench of this Court has granted anticipatory bail to co-accused, Vikash Kumar on

4/4 almost similar allegations.

Taking into consideration the facts aforesaid, let the petitioner, above-named, in the event of her arrest or surrender within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Nawada Town P.S. Case No.913 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S. with a further condition that:- The learned court concerned shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed her criminal antecedent, the court concerned shall take steps for cancellation of bail bond of the petitioner. However, the acceptance of bail bond in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
