2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 272, 273 & 420 of the Indian Penal Code and Sections 30a, 32(i)(ii)(iii), 33, 38, 41(i) (ii) of the Bihar Prohibition and Excise Act.

3. 544.94 liters illegal liquor was recovered from the house of co-accused. Petitioner's name has figured during course of investigation in confessional statement of co-accused. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent.

4. Considering the facts of the case, this pre-arrest bail petition is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand)

Patna High Court CR. MISC. No.35556 of 2023(2) dt.21-07-2023 2/2 with two sureties of the like amount each to the satisfaction of the 2nd Exclusive Special Excise Court, Saran at Chapra in Sahajitpur Police Station Case No. 34 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
