JUSTICE ANIL KUMAR SINHA ORAL ORDER 21-04-2023 Heard learned counsel for the parties concerned. The petitioner has filed the present writ application being aggrieved by the order of termination passed by the District Programme Officer, Madhubani from the post of Primary Teacher from Malmal Uttri (Kaluahi) on the ground of having been produced forged certificate.

Learned counsel for the State submits that the petitioner has directly approached this Court without availing

Patna High Court CWJC No.811 of 2018(10) dt.21-04-2023 2/2 the remedy before the District Appellate Authority which has been constituted and is functioning in the concerned District. Taking into consideration the nature of dispute, this writ application is disposed of with liberty to the petitioner to approach the District Appellate Authority, Madhubani. It is made clear that if the appeal is filed by the petitioner along with the condonation of delay petition, the District Appellate Authority shall consider the same in accordance with law.
