JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 15-11-2016 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing of the order dated 6.1.2014 passed by the learned Judicial Magistrate, 1st Class, Patna by which he has taken cognizance for the offences punishable under Sections 323, 379, 504 and 498A of the Indian Penal Code and summoned the petitioner to face trial.

2. I have perused the complaint and other materials brought on record. There is allegation that the petitioner, being husband of the complainant - opposite party no.2, subjected her to cruelty for non-fulfillment of demand of dowry. The complainant and other enquiry witnesses examined under Section 202 of the CrPC

Patna High Court Cr.Misc. No.5241 of 2014 dt.15-11-2016 2/2 have supported the allegations made in the complaint. The matter was also sent to the Patna High Court, Mediation and Conciliation Centre. The Mediator has reported that despite best efforts the parties failed to resolve their dispute through the process of mediation.

3. In that view of the matter, I see no reason to interfere with the impugned order dated 6.1.2014 passed by the learned Judicial Magistrate, 1st Class, Patna.
