JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Admittedly, there is case and counter case between the parties and both parties are making wild allegations against each others.

In the present case, petitioner No. 2 is said to have given rod blow to injured Prabhu Sah, causing injury on his head but injury of Prabhu Sah is not on the record. So far as injured Kiran Devi @ Rajanti Devi is concerned; it appears that she sustained four injuries and out of which, opinion regarding two injuries, was kept reserved but even after passing of more than two months, no X-ray report or any other material was brought before the concerned doctor and thereafter, concerned doctor

Patna High Court Cr.Misc. No.31293 of 2015 (4) dt.15-10-2015 2/2 expressed his inability to give any opinion, regarding the nature of aforesaid injuries of injured Kiran Devi @ Rajanti Devi. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Mirganj P.S. Case No. 151 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj. (Hemant Kumar Srivastava, J) A.K.V./- U T
