ANSHUMAN ORAL ORDER 04-10-2023 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Sasaram, Bhabhua, Central Co-operative Bank Ltd.

Learned counsel for the petitioner fairly submits that the present writ petition has been filed for quashing the termination order dated 14.09.1988 which has been served upon him vide memo No. 233 and also the order dated 02.12.1996 passed by the Registrar, Co-operative Society, Patna, Bihar in Misc. Case No. 174/95.

3. Learned counsel further submits that during the pendency of the present writ petition, the petitioner has completed the age of his superannuation.

Learned counsel for the State submits that the petitioner has moved before this Hon'ble Court after a long gap whereas, counsel for Sasaram, Bhabhua, Central Co-operative Bank Ltd submits that after the judgment rendered by a Special Bench of this Court in the case of Organizer, Delhi C.D. & C.M

Patna High Court CWJC No.3258 of 2018(5) dt.04-10-2023 3/3 Union Ltd. Vs. The State of Bihar reported in 2014 (1) PLJR 695, the writ petition is not maintainable and liberty is available to the petitioner only under the rules and regulations of Bihar Co-operative Bank and not in the petition.

5. It transpires to this Court that the issue involved in this writ petition is question of regularization and age of superannuation. Since the petitioner has acquired the age of superannuation, this writ petition has become infructuous.

6. Accordingly, the writ petition stands dismissed as having become infructuous.
