2. The petitioner is in custody since 02.01.2023 in connection with Gaurichak P.S. Case No. 831 of 2022 registered for the offence punishable under Sections 302/21 of the Indian Penal Code.

3. As per the prosecution case, on 14.12.2022, in the morning, the mother of the informant, namely, Sunita Devi, went out the house and when she did not return back at night, on 15.12.2022, the informant searched and enquired about his mother. Her dead body was found lying near Tractor Godown. It seems that the death caused due to head injury, caused by hard and blunt object. F.I.R. was register against unknown. It has been submitted by learned Senior Counsel for the petitioner that there is no evidence against the petitioner except the confessional statement of co-accused persons which has no evidentiary value. It has been further submitted that coaccused Kameshwar Kumar has been granted bail by this Court vide order dated 07.07.2023 passed in Cr. Misc. No. 37096 of 2023.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail after framing of charge, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VI, Patna City, Patna in connection with Gaurichak P.S.
