JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-11-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 392 of the Indian Penal Code, registered in connection with Bettiah Town P.S. Case No. 116 of 2020.

As per allegation, the unknown miscreants concealing their face entered into the shop namely Mahindra Finance Company. At the point of pistol, they snatched Rs 1,01,400 from the cash counter. They also took away laptop and mobile from the shop. Learned counsel for the petitioner has submitted that the petitioner is an Ex-Mukhiya and due to election rivalry he has been implicated by co-accused Afzal Ansari who has taken the name of the petitioner in his confessional statement. He has submitted further that for election rivalry he has been implicated in some other cases as mentioned in paragraph no. 3 of the bail petition. He has also submitted that Afzal Ansari in whose confessional statement the name of the petitioner has figured has been granted regular bail.

No.35380 of 2022(3) dt.02-11-2022 2/2 Considering the above-mentioned facts and circumstances, especially the fact that the petitioner is an ExMukhiya and there is nothing against him, except the confessional statement of co-accused Afzal Ansari and also considering the period of his custody since 28-07-2021, let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 116 of 2020.

The petitioner shall appear in the court below on each and every date till framing of charge, except unavoidable reasons. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove, failing which the matter shall be brought to the notice of this Court.
