23-01-2015 Heard Sri Kameshwar Prasad Gupta, learned counsel for the petitioner and Sri Ratan Prasad Sinha, learned counsel, who appears on behalf of Respondents.

Learned counsel for the Respondents submits that during the pendency of the present writ petition, all the grievances of the petitioner have already been redressed. He further submits that a detailed statement has been made in paragraph-2 of the counter affidavit regarding redressal of the grievances of the petitioner, which are as follows:

(i) The petitioner is regularly getting pension from Electric Supply Subdivision, Sitamarhi;

Patna High Court CWJC No.3054 of 2014 (2) dt.23-01-2015 2/3 (ii) GSS amount of Rs.126109/- has been paid through Cheque no.051382 dated 07.03.2014;

(iii) GPF amount of Rs.620615/- has been paid through Cheque no.05502 for dated 10.01.2015;

(iv) Gratuity amount of Rs.350000/- has been paid through Cheque No.380790 dated 06.01.2015 and revised Gratuity amount of Rs.326220/- has been paid through cheque No.871259 dated 12.01.2015;

(v) Leave Encashment: amount of Rs.330596/- has been paid through Cheque No.053079 dated 05.08.2014;

(vi) Differential amount of revised salary has already been calculated and deposited in GPF amount of the petitioner by the Circle Office;

(vii) Over time allowance: an amount of Rs.51620 has been paid through cheque no.055018 dated 08.01.2015;

(viii) T.D.S. Form for the financial year 2013-14 has already been given to the petitioner through letter no.911 dated 15.07.2014.

It has also been indicated that if the petitioner finds that any payable due amount has not been paid to him, he may file a representation, which shall be disposed of within a reasonable period in accordance with law.

In view of facts disclosed in the counter affidavit, the writ petition can be disposed of with an indication that if the

Patna High Court CWJC No.3054 of 2014 (2) dt.23-01-2015 3/3 petitioner feels that any grievance still exists, he may file a representation before the Respondent no.3/ the Executive Engineer, Electric Supply Division, Jhanjharpur within eight weeks from today. If such representation is filed within time, Respondent no.3 is required to examine the same and redress the grievances of the petitioner in accordance with law. Even in case of refusal to the claim of the petitioner, Respondent no.3 is required to pass a speaking order within two months thereafter and communicate the same to the petitioner within the aforesaid time. The writ petition stands disposed of.
