The petitioner seeks bail in a case for the offences punishable under sections 386 and 120 (B) of the I.P.C Allegedly, co-accused Munna Kumar @ Avinash Kumar demanded ransom of Rs. 1,00,000/- from the informant in the name of the petitioner and others and at that time the petitioner was in custody.

Submission is of false implication and that the petitioner has got no concern with co-accused Munna Kumar, at the time of occurrence the petitioner was in custody in another case and only on the basis of criminal antecedent he has been

Patna High Court Cr.Misc. No.30975 of 2015 (4) dt.04-01-2016 2/2 implicated in this case also resulting he is suffering in custody since 18.04.2015, charge sheet has already been submitted and there is no chance of tampering with the prosecution evidence. The learned A.P.P. fairly submits that the petitioner was not caught and his name was taken by the co-accused. In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Motihari, East Champaran in Turkaulia P.S. Case No. 98 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
