The petitioner is languishing in custody since 14.01.2019 in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. It is alleged that the petitioner was trying to flee away with the motorcycle of the informant parked in front of ATM booth.
It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the petitioner has been roped in the present case and the investigation has already been concluded. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.
Patna High Court CR. MISC. No.34174 of 2019(2) dt.27-05-2019 2/2 Learned APP for the State submits that the petitioner was trying to flee away with the motorcycle of the informant. Considering the nature of accusation, investigation already being concluded, coupled with the fact that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 20 of 2019.
