This is the second attempt of the petitioner for bail as earlier such prayer was rejected by order dated 26.11.2014 passed in Cr. Misc. No. 14647 of 2014, by which the Court below was directed to expedite the trial and conclude the same within six months. Learned counsel for the petitioner submitted that he is in jail for a long period. However, he has not been able to show to the Court any mitigating circumstances after the last rejection order which may warrant interference.

Learned A.P.P. submitted that he is the sole accused and the informant as well as other witnesses have seen him assaulting the deceased and there is no inconsistency in their statement.

Patna High Court Cr.Misc. No.32059 of 2015 dt.11-01-2017 2/2 Having regard to the same, the Court does not find any occasion to release the petitioner on bail. Accordingly, the prayer for bail stands rejected.

However, in view of the report submitted by the Court below, let trial be concluded latest by 30th June, 2017, failing which this Court shall be constrained to take a strict view in the matter. Registry shall communicate the order to the Court below through Fax also latest by tomorrow.
