Learned counsel for the petitioners submits that petitioner no. 2 has already expired during the pendency of the present application. As such, learned counsel for the petitioners seeks permission of the Court to withdraw the application in respect of petitioner no. 2.

The present application is dismissed as withdrawn in respect of petitioner no. 2.

On behalf of the informant, it has been submitted that process under Sections 82 and 83 has already been issued against the petitioner no. 1 in connection with Saran Mahila

Patna High Court CR. MISC. No.45807 of 2021(2) dt.04-04-2022 2/2 P.S. Case No. 39 of 2021.

In the said circumstances, the present anticipatory bail application in respect of petitioner no. 1 is not maintainable before this Court.

The present application stands disposed of in respect of petitioner no. 1 with liberty to the petitioner no. 1 to appear before the Court below and make appropriate application for regular bail. If any such application is filed by petitioner no. 1, the same shall be considered on its own merit without being prejudiced by this order.
