2. This application for anticipatory bail arises out of Kotwa P.S. Case No. 61 of 2023, registered for the offence punishable under Section 379, 411, 414, 34 of the Indian Penal Code.

3. As per allegation, the pumping set, worth Rs.5,000.00, of the informant was stolen away. The informant came to know that co-accused Vicky Kumar and Vikash Kumar have stolen the pump set and sold it to the petitioner.

4. Learned counsel for the petitioner has submitted that he has purchased the said pump set from OLX site for an amount of Rs.6,000.00 and the payment was done in the UPI account of the mother of co-accused Vicky Kumar and hence the petitioner was not aware about the fact that the pump set was

Patna High Court CR. MISC. No.34460 of 2026(2) dt.19-05-2026 2/2 stolen one and it has also not been alleged in the FIR that the petitioner had purchased the pump set knowing the fact that it was stolen one. It has lastly been submitted that the petitioner has got no criminal antecedent.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioner.

6. Heard the parties and perused the record.

7. Considering the facts and circumstances, let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, East Champaran, Motihari, in connection with Kotwa P.S. Case No. 61 of 2023, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
