JUSTICE AMARESH KUMAR LAL ORAL ORDER 19-08-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 465, 467, 468 and 471 of the Indian Penal Code.

The allegation against the petitioner is that he has a mobile repairing shop. He was indulged in selling the mobile SIM to be registered in the name of genuine person, but sold to different person.

It is submitted that the petitioner has no criminal antecedent. In similar circumstances, co-accused Santosh Kumar has been granted bail vide order dated 12.01.2015 passed in Criminal Misc. No. 891 of 2015.

Learned counsel for the State submits that petitioner was remanded in this case on 01.06.2015 whereas, the co-accused Santosh Kumar was in custody since 29.09.2014. After

Patna High Court Cr.Misc. No.31072 of 2015 (2) dt.19-08-2015 2/2 investigation, case has been found true and the charge-sheet has already been submitted against the petitioner. Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri (Sitamarhi)/Court concerned after framing of charge concerned in Sursand P.S. Case No. 236 of 2014 with the following conditions :

1.

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
