The petitioner is languishing in custody since 10.03.2019 in a case registered for the offences punishable under Sections 147, 148, 149, 121, 121A,427, 435 of the Indian Penal Code, Sections 4/5 of the Explosive Substances Act and Sections 18,20,22 and 23 of the Unlawful Activities (Prevention) Act, 1967.
It is alleged that the petitioner along with others in order to terrorise the villagers put the crops on fire and exploded bomb and also threw some Naxalite literature. It is submitted by learned counsel for the petitioner that the accusation is against the mob and the petitioner is accused in one other case apart from the present case. It is
Patna High Court CR. MISC. No.34731 of 2019(2) dt.28-05-2019 2/2 further submitted that similarly situated co-accused, Karelal Kora has been granted bail by a Co-ordinate Bench of this Court vide order dated 04.02.2019 passed in Criminal Miscellaneous No.5972 of 2019.
Learned APP for the State submits that the petitioner along with others tried to terrorise the villagers. Considering the omnibus and general nature of accusation and similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-III, Munger in connection with G.R No. 409 of 2018 (arising out of Laraya Tand P.S. Case No. 6 of 2018).
Since the petitioner is having serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or substantially gets involved in some serious nature of offence.
