2. Notwithstanding the superannuation of the petitioner long back on 31.12.2023 from the post of Professorcum-Head of the Department of Orthopedics, Nalanda Medical College, Patna, when he has not been accorded the admissible retiral benefits and other dues, the present writ petition is preferred.

3. Considering the nature of the relief(s) and the fact that for ventilating the grievance the petitioner has already preferred a representation, copy of which is marked as Annexure-2 to the writ petition, this Court deems it fit and

Patna High Court CWJC No.8436 of 2024 dt.24-04-2025 2/2 proper to dispose of the present writ petition with a direction to the Additional Chief Secretary, Health Department, Government of Bihar, Patna to consider the representation of the petitioner and dispose of the same by passing a reasoned and speaking order, preferably within a period of ten weeks from the date of receipt/production of a copy of this order.

4. Suffice it to observe that the petitioner shall be at liberty to file a supplementary representation, if he so desired, within a period of two weeks. While disposing of the representation, the supplementary representation filed by the petitioner shall also be considered. In case the claim of the petitioner finds favour, the consequential admissible retiral benefits shall also be accorded to the petitioner within the period stipulated.

5. The writ petition stands disposed of with the aforesaid observation and direction.
