JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks regular bail in connection with Begusarai (Rail) P.S. Case No. 15 of 2021 dated 12.03.2021 instituted for the offences under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.03.2021 and charge-sheet has been submitted in the case.

Learned counsel for the petitioner submits that informant in the F.I.R. alleges that while he along with his wife alighted from train, one unknown accused snatched the gold chain of his wife but was apprehended by Rail Police and the accused disclosed his name as petitioner but from his possession the gold chain was not recovered as he had given the same to the his associate.

No.45953 of 2021(2) dt.06-01-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case as in the F.I.R. it is alleged that he was apprehended at the place of occurrence itself but then also nothing was recovered from his possession. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 13.03.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Rail J.M., Barauni, Begusarai in connection with Begusarai (Rail) P.S. Case No. 15 of 2021 with a condition that the petitioner will keep marking his attendance in between 25-30 of every month commencing from January, 2022 in the concerned police station till framing of charge and in the event it is reported by the concerned police station that the petitioner has not marked his attendance in any of the month in between the aforesaid dates till framing of charge, the court below will proceed to cancel his bail bonds.
