JUSTICE HARISH KUMAR ORAL ORDER 01-06-2026 Heard Mr. Sudhir Kumar Mishra, learned Advocate for the petitioner and Mr. Pradeep Narain Kumar, learned Additional Public Prosecution for the State through virtual mode.
2. The petitioner apprehends his arrest in connection with Amarpur P.S. Case No. 27 of 2026, registered for the offences punishable under Sections 126(2), 115(2), 109(1), 352, 351(2), 3/5 of the Bharatiya Nyaya Sanhita, 2023.

On the alleged date and time of occurrence, while the informant went to see his maize crop, in the meanwhile, the petitioner along with his brother, came there and threatened to withdraw the earlier case bearing no. 726 of 2024. On the objection raised by the informant, it is alleged that co-accused Ranjeet Kumar Singh carrying iron rod on his hand, assaulted
Patna High Court CR. MISC. No. 35330 of 2026(2) dt.01-06-2026 2/3 him over his head due to which he sustained serious injury. This petitioner also assaulted the informant by means of lathi and danda.

Learned Advocate for the petitioner submitted that in fact on the alleged date of occurrence on account of some land dispute, the parties have entered into a free fight resulting into some unfortunate injuries and there is a counter version of the present case being Amarpur P.S. Case No. 28 of 2026. It is submitted that in fact in the said occurrence, the brother of the petitioner was brutally assaulted at the hands of the informant and his persons due to which he sustained two grievous injuries. To support the aforesaid contention, a copy of the F.I.R. as well as injury report have been placed on record as Annexure- P/2 and P/3. It is lastly contended that even if the allegation levelled in the F.I.R. is taken to be true, it is co-accused Ranjeet Kumar Singh who has assaulted over the head of the informant by means of iron rod which resulted into grievous injury. The petitioner undertakes that he will fully cooperate in the proceeding of the court and do not indulge in such incidence in future.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the

Having considered the nature of allegation coupled with the factum of case and counter-case as well as the fact that the injury which is sustained over the head of the informant is not attributed to the petitioner, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 27 of 2026, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
