JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-11-2022 The learned counsel for the petitioners seeks permission to delete the petitioner no. 1 i.e. Jyoti Prakash from the array of parties. Permission so sought, is granted. The needful be done during the course of the day. The present writ petition has been filed seeking the following relief :- "(1) For issuance of a writ in the nature of mandamus or any other appropriate writ, order or direction for commanding and directing the respondent authorities to
Patna High Court CWJC No.10736 of 2020(2) dt.14-11-2022 3/3 demolish/ remove the unauthorized and illegal construction having been erected in top floor of the Quality Complex Apartment (hereinafter referred to as 'Apartment') and further to stop the functioning of an office of political party in the Quality Complex, a residential apartment situated in residential area of North Mandiri and to restrain them from conducting political activities within the premises of the Quality Complex Apartment."
At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the Municipal Commissioner, Patna Municipal Corporation, Patna for redressal of their aforesaid grievance. Liberty so sought, is granted. It is needless to state that in case, appropriate representation is filed by the petitioners within a period of four weeks from today, appropriate decision shall be taken thereon, in accordance with law and after hearing the affected parties, within a period of 12 weeks, thereafter.
The writ petition stands disposed off on the aforesaid terms.
