2. The petitioner apprehends arrest in connection with Patori P.S. Case No. 273 of 2014 dated 31.08.2014, instituted for the offence punishable under Sections 273 of the Indian Penal Code and 47(A) of the Bihar Prohibition and Excise Act.
3. As per the case of prosecution, 460 litres countrymade liquor has been recovered from the veranda of the house of Vijay Chaudhary which was unloaded from the Discover motorcycle bearing Registration No. BR33L-5763.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that nothing has been recovered from the possession of the petitioner. The petitioner was neither present on the spot nor arrested by the police. The petitioner has

Only on the basis of confessional statement of one Surendra Rai, the petitioner has been made accused in this case. Lastly, it has been submitted that the petitioner has two criminal cases against him.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest/surrender of the petitioner in connection with Patori P.S. Case No. 273 of 2014, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned court of Exclusive Special Excise Court-Iind, Samastipur, subject to condition as laid down under Section 438(2) of the Cr.P.C.
