Supplementary affidavit has been filed on behalf of the petitioner bringing on record copies of deposition of five witnesses in the case.

This is the second attempt of the petitioner for bail in connection with Mansahi P.S. Case No. 93 of 2013 dated

Patna High Court Cr.Misc. No.29811 of 2015 dt.16-12-2015 2/3 13.10.2013 instituted under Sections 302/201 of the Indian Penal Code as earlier his prayer was rejected on 12.12.2014 in Cr. Misc. No. 16791 of 2014.

Learned counsel for the petitioner submits that out of ten prosecution witnesses, five have been examined and they have not taken the name of the petitioner. It is further submitted that out of the remaining five witnesses, four are official witnesses and the other is the informant.

At this stage, learned A.P.P. submits that the Court may direct the prosecution witnesses to be examined within a fixed period and thereafter the Court be directed to conclude the trial. Learned counsel for the petitioner agrees to such suggestion.

Accordingly, the application stands disposed off with a direction to the court below to ensure that the remaining five witnesses are examined within six weeks. The Court shall inform the Superintendent of Police, Katihar with regard to production of witnesses for examination. The Superintendent of Police, Katihar is also directed to ensure that all the official witnesses are produced before the Court on the dates which may be fixed for their examination. The Court shall thereafter conclude the trial within one month from the date the last prosecution witness is examined

Patna High Court Cr.Misc. No.29811 of 2015 dt.16-12-2015 3/3 subject to cooperation by the petitioner.

The Court makes it clear that the time schedule noted above shall be strictly complied with.

Registry shall communicate the order to the court below as well as the Superintendent of Police, Katihar through Fax also latest by tomorrow.
