JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 30-03-2022 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by the Stamp Reporter within two weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Akhileshwar Dayal, learned APP for the State. The petitioner in the present case is seeking regular bail in connection with Naya Ramnagar P.S. Case No. 09 of 2021 registered for the offences punishable under Sections 447, 326, 302 of the Indian Penal Code. He is in custody since 11.01.2021 and has no criminal antecedent.

Learned counsel for the petitioner submits that as per the prosecution story, on 10.01.2021, this petitioner had entered into the house of the victim lady and set her on fire. Thereafter the victim was taken to Sadar Hospital where she made her statement before the Executive Magistrate, Munger and the S.H.O. of the

Patna High Court CR. MISC. No.45144 of 2021(4) dt.30-03-2022 2/2 concerned police station. The victim died in course of her treatment. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is in custody since 11.01.2021 having no criminal antecedent.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Having regard to the material present in the case diary showing that on the alleged date of occurrence at about 03:50 P.M. the victim lady had made her statement in Sadar Hospital, Munger, in presence of the Executive Magistrate, Sadar, Munger and the S.H.O. of the concerned police station saying that this petitioner had entered into the house of the victim and burnt her, this Court is not inclined to release the petitioner on bail. The prayer for bail of the petitioner is, thus, refused.

Let the trial be expedited.
