JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual court proceedings. The petitioners seek bail in connection with N.D.P.S. Case No. 02 of 2021, arising out of Birpur P.S. Case No. 64 of 2021 instituted for the offences under Sections 8, 20(b) (ii) (A) of the N.D.P.S. Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 25.02.2021, are persons with clean antecedent and charge-sheet has been submitted in the case.

Learned counsel for the petitioners submits that allegation is of recovery of 1.25 kg of ganja from accused

Learned counsel for the petitioners submits that the alleged recovered ganja is much less than the commercial quantity.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody since 25.02.2021, charge-sheet has been submitted in the case, the petitioners are persons with clean antecedent and the recovered ganja is 1.25 kg, let the petitioners above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cumSpecial Judge, N.D.P.S., Supaul in connection with N.D.P.S. Case No. 02 of 2021, arising out of Birpur P.S. Case No. 64 of 2021.
