JUSTICE SANDEEP KUMAR ORAL ORDER 12-07-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Husainganj P.S. Case No. 162 of 2022, registered for the offence punishable under Sections 147, 341, 323, 324, 326, 504, 506, 302 of the Indian Penal Code.

Learned counsel for the petitioners submit that the petitioners is innocent and has falsely been implicated in this case. Petitioners have clean antecedent. Considering the fact that Lal Bahadur Ram is the assailant of the deceased and there is general and omnibus allegation against the petitioners. One of the co-accused namely Punit Kumar has already granted

Patna High Court CR. MISC. No.35658 of 2023(2) dt.12-07-2023 2/2 anticipatory bail in Cr. Misc. No. 5324 of 2023 vide order dated 10.04.2023. Petitioners are in custody since 21.03.2023. Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation and also period period of custody, this application is allowed. Let the petitioners, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Husainganj P.S. Case No. 162 of 2022.
